The political landscape in Kenya is currently charged with tension as the National Assembly prepares for a significant motion aimed at the impeachment of Deputy President Rigathi Gachagua. This development follows Speaker Moses Wetang’ula’s approval of the motion, which has garnered substantial support from Members of Parliament (MPs).

The Motion’s Approval and Initial Reactions

The atmosphere in the National Assembly was electric when Speaker Wetang’ula announced the receipt of the impeachment motion filed by Mwingi West MP Mwengi Mutuse. The announcement was met with thunderous applause from the MPs, indicating a collective enthusiasm for the proceedings. The House was filled to capacity, reflecting the gravity of the situation as Wetang’ula outlined the next steps regarding the motion, confirming that it met all necessary legal requirements.

Support for the Motion

The motion gained momentum quickly, with 291 MPs signing the petition initiated by Kibwezi West MP Mutuse. This number exceeds the constitutional requirement of one-third of the 349 MPs, which is set at 117 members. If the motion receives backing from at least two-thirds of the National Assembly—233 MPs—it will be forwarded to the Senate for further deliberation.

The Impeachment Process

Once the motion is passed in the National Assembly, the Speaker will notify the Speaker of the Senate within two days. During this interim period, Deputy President Gachagua will continue to perform his duties. The Senate is then required to convene within seven days to address the charges against him. A special committee of 11 members may be appointed to investigate the allegations, with a report due within ten days.

The Deputy President will have the right to defend himself during this investigation. If the committee finds the allegations unsubstantiated, no further action will be taken. However, if the allegations are upheld, the Senate will vote on the impeachment charges. A two-thirds majority in the Senate will result in Gachagua’s immediate removal from office.

Allegations Against Gachagua

The motion outlines several serious allegations against Deputy President Gachagua, including gross violations of the constitution and various criminal offenses. MP Mutuse, who is serving his first term under the Maendeleo Chap Chap party, emphasized that his actions are not personal but rather a fulfillment of his constitutional duties.

Among the accusations are claims of violating multiple articles of the Kenyan Constitution, including those related to discrimination and incitement. The motion states that Gachagua has made inflammatory remarks that threaten national unity and could alienate various ethnic communities within Kenya.

Financial Misconduct Allegations

In addition to constitutional violations, Gachagua faces serious charges under the Anti-Corruption and Economic Crimes Act. The motion alleges that he has amassed a property portfolio valued at approximately Sh5.2 billion, raising suspicions of corruption and money laundering. The disparity between his known legitimate income and his wealth has prompted concerns about the sources of his assets.

The motion details that Gachagua’s wealth is allegedly linked to his family members, including his spouse and two sons, suggesting a potential conflict of interest and abuse of office.

Claims of Misconduct and Sabotage

The motion also accuses Gachagua of gross misconduct, particularly in his role as Deputy President. It alleges that he has undermined the presidency and sabotaged government efforts in key sectors such as agriculture. Specific accusations include collusion with cartels in the tea industry to obstruct beneficial policies for smallholder farmers.

Safety Concerns for MPs

As the impeachment motion unfolds, concerns regarding the safety of the 291 MPs who signed the petition have been raised. Majority Leader Kimani Ichung’wah urged the Inspector General of Police to ensure the safety of all MPs involved in the proceedings. He emphasized the seriousness of the situation, describing Gachagua as a formidable opponent.

Minority Leader Junet Mohamed echoed these sentiments, stressing the constitutional nature of the impeachment process and the need for adequate protection for lawmakers during this politically charged time.

As the National Assembly prepares for the upcoming vote on the impeachment motion, the political ramifications of this development are significant. The outcome will not only affect Gachagua’s political future but also set a precedent for accountability at the highest levels of government in Kenya.
